Hijab ban case: ‘Like turban for Sikhs, hijab important for Muslim women’, petitioners’ lawyer tells SC

A Supreme Court bench of Justices Hemant Gupta and Sudhanshu Dhulia continued hearing petitions challenging the ban on wearing hijab in educational institutions in Karnataka for the seventh day on Monday.

The top court will hear again on Tuesday at 11 am. According to live lawSenior advocate Dushyant Dave will be allowed to present his arguments till 1 pm, after which no one else will be allowed on behalf of the petitioner.

During the hearing, Mr. live law Senior advocate Dushyant Dave, appearing for one of the petitioners, said, “It is not about uniforms. We are not dealing with military schools, we are not dealing with regiments with Nazi schools. -Working with university colleges.

Continuing his arguments, advocate Dave said: “Like turban for Sikhs, hijab is important for Muslim women. Nothing wrong with him. This is their belief. Some want to wear tilak, some want to wear a cross, everyone has the right. And that is the beauty of social life.”

“This country is built on a beautiful culture…built on traditions. And in 5000 years, we have adopted many religions… India gave birth to Hinduism, Buddhism and Jainism. Islam came here without victory and we accepted. India is the only place where people who came here left the British and settled here without any victory.”

Pointing out that Dr BR Ambedkar and Sardar Vallabhbhai Patel’s fears were coming true, Dave said: “How is this unity in diversity if a Hindu has to take permission from a magistrate to marry a Muslim? How can you bind love? And the magistrates will take their sweet time and all the fringe elements will kick in. How is this democracy? ,

“Your sovereign is not the only custodian of fundamental rights for our citizens. Your dominion can stand alone among parliamentary excesses and citizens. bar and bench Advocate Dushyant Dave was quoted as saying.

Noting that powerful Western economies have taken an approach and allowed the hijab, Dave continued: “The US military has allowed the turban. That’s the respect they have for religions. The makers of the constitution wore the turban. Didn’t talk, only saber.

“For this Court the only religion that matters is the Constitution of India. As important as the Gita for Hindus, Quran for Muslims, Guru Granth Sahib for Sikhs and Bible for Christians, without the Constitution, we would be nowhere . live law Quoting Dave.

When Advocate Dave referred to the debate on Article 25 and said it was “based on tolerance”, Justice Dhulia asked whether anyone in the Constituent Assembly had said why it was important to include “propaganda” in Article 25. “Perhaps, what is given is the reason. In some religions, such as Christianity, it is an important part of the faith to spread the message,” live law Justice Dhulia was quoted as saying.

When Advocate Dave claimed that “the judges of the High Court have not really understood what is constitutional morality, what is constitutionalism and what is constitutional philosophy,” Justice Dhulia said: “The problem that the High Court has set for itself That is whether it is a necessary religious practice, it believes it is only a guide, it discusses fundamental rights and says that when it comes to class, there are no fundamental rights.”
